No caso da Fernão Dias, a OHL ofereceu deságio de 65,4% e se comprometeu a cobrar dos veículos de passeio R$ 0,997 por praça de pedágio. Para conseguir a concessão da Régis Bittencourt, os espanhóis propuseram um desconto de 49%, fixando o pedágio em R$ 1,364. No caso da ligação Curitiba-Florianópolis, o grupo ofereceu deságio de 62,67%, reduzindo o pedágio para R$ 1,028.
Técnicos da ANTT disseram que a lei mencionada pelo consórcio PR/SC para questionar as vitórias da OHL não se aplica ao leilão de rodovias. A procuradoria da agência avalia que os limites estabelecidos pela lei 9.648 só se aplicam a leilões feitos com base na Lei de Licitações (lei 8.666). O leilão de rodovias se baseia no Programa Nacional de Desestatização (PND).
